Not sure on what that is for sure. Probably an overlay with 1938S-1MM-001 to see if the location for the mintmark would probably be where to start. That is the first thing to do. it could have been a die gouge or a worn RPM. Whether it is that die or not is the first thing to do. An overlay would give you the answer if the location is the same.

Something I just noticed, The RPM book, page 16 for this RPM lists it as a West and not a North. Looks like a mistake in their book to me. The site has it correct. It is a North.

I agree with Coop, a overlay would tell. Just by viewing the 1938S-1MM-001 on Coppercoins, I would tend to agree that it is a VLDS. Nice find Steven

The layover seems to line up perfectly as well as the raised area above the primary MM.

Any matching of markers from the LDS die state? The MDS is so strong and the LDS gets weaker, so the VLDS should show more of markes that may have been started on the earlier die states. Scratches can fad if in the fields/die cracks/chips & breaks get progressively worse. But the beginning of a strong marker may be noted on the prievious die state. See if you can find strong markers and see if they carry over from the prievious die state?

The markers listed as the gouge above the N of IN in the EDS that begins to fade in the LDS, the scrathes above EP in the LDS are not visible to me on this coin. However I did notice that at the MM itself inside the upper loop of the S shows, on the sites photos, what appears to be the center curve of the secondary MM. and that is present on this coin. I do not find and chips or cracks.
